Norway 'child abuse' case: Indian couple charged


The Indian couple arrested here in an alleged child abuse case have been charged with "gross repeated maltreatment" of their child for which the prosecution has proposed a minimum sentence of one-year and three months for the parents.

According to a statement by Oslo Police Department, the couple have been remanded in custody, as there is reason to fear that they will evade prosecution by returning to India.

The Court of Appeals in process of hearing the defence's appeal and the judgement will be pronounced in Oslo District Court on December 3.

"The couple have been charged with gross repeated maltreatment of their child/children by threats, violence or other wrong under section 219 of the Penal Code," Police Department said.

"The prosecution proposed a sentence of one-year three months for the mother and one-year six months for the father. The judgement in the case would be pronounced on Monday, December 3."

Chandrasekhar Vallabhaneni, a software professional from Andhra Pradesh, and his wife his wife Anupama - an officer of the Indian embassy were taken into custody by the police in Oslo.

The police arrested Chandrasekhar after his 7-year-old child complained to his school teachers that his parents were threatening to send him back to India for his acts, Chandrasekhar's nephew V Sailender, who is in Hyderabad, claimed.

The boy was found wetting his pants in the school bus which was reported to his father, who in turn "threatened" the child that he would be sent back to India if he repeated that again, Sailender said, adding the boy was also found bringing toys from school.

The incident comes barely months after another row involving an Indian couple and their children.

Abhigyan (3) and Aishwarya (4) were taken away from their parents --Anurup and Sagarika Bhattacharya -- by Norway's Child Welfare Society in May last year on grounds of "emotional disconnect".

Mumbai splurges Rs 1,000 crore on weddings in a day

As lakhs of Mumbaikars attended 30,000-odd weddings during Friday's special mahurat, anecdotal evidence suggests that over Rs 1,000 crore was transacted on the day. Wedding planners, caterers, decorators and music bands had their hands full as they juggled several venues all at once.

Industry experts say the wedding market in India is worth over Rs 1.25 lakh crore, and Mumbai contributes a big share. "People splurge up to Rs 20-25 lakh on the marriage day, not to mention sangeet, mehndi and the honeymoon," said Farhat Hussain, manager of Mayfair Banquets in Worli.

Trousseau, wedding gifts, flowers, decorations, henna and makeup artists as well as photographers all come at a premium with demand peaking, not to mention gold that almost hit Rs 33,000 per 10gm this past week driven by the onset of marriage mahurats.

Homogenized by Hindi cinema, the Indian wedding has ballooned beyond the nuptials and is now spread over a leisurely three to four days. Mehndi, sangeet and cocktail functions, once the preserve of a particular community or class, are commonplace. Small wonder that henna artist Jyoti Chheda was sleep-deprived from having worked 24/7 over the past few days.

Five brides, all of whom were married on Friday, had requisitioned her services, causing her to shuttle from one house to another. Marked for four weddings, bandmaster Ashok Bhambri rushed from Ghatkopar to Vashi while deploying two teams to manage the rush in Chembur.

Pandit Prakash Pendse of Thane performed at one wedding during the noon mahurat and another at 6.30pm, receiving a fee of Rs 15,000 at each. "The affluent pay anywhere from Rs 50,000 to a lakh."

The economic swing in the wedding market is so vast that all income groups find optimum choice should they shop in time. The Kite Bhandary community hall in Dadar is hired for as little as Rs 30,000-50,000 while Dadasaheb Gaikwad Sabhagruha at Four Bungalows charges around Rs 1 lakh, with a rider that the party use the inhouse caterer. "The caterer charges Rs 600-800 per head," said spokesperson Vijay Jadhav.

The catering is a mix of different palates. Jayaleela Banquets in Goregaon charges Rs 400-600 a plate while Mayfair levies Rs 1,600 plus taxes on its non-vegetarian menu. Mayfair Banquets' Farhat Hussain said Mumbaikars "spend a bomb", particularly on theme weddings that take place at night.

Hours before the Friday noon mahurat, florists in Bandra fetched bundles of fresh tuberose, marigold and rose for decoration. "These flowers are typically suited to an Indian theme, but there are clients who prefer the classy look of orchids and anthuriums," said Preeti Karma of Karma Florist.

Despite the knowledge that people splurge on weddings, planner Rupali Goshalia was surprised by the thousand-crore investment in a single day. "I myself advocate a simple, registered wedding to my relatives but no one listens," she said.

Tender Love Saves Life

Twin girls, Brielle and Kyrie, were born 12 weeks ahead of their due date. Needing intensive care, they were placed in separate incubators.

Kyrie began to gain weight and her health stabilized. But Brielle, born only 2 lbs, had trouble breathing, heart problems and other complications. She was not expected to live.

Their nurse did everything she could to make Brielle's health better, but nothing she did was helping her. With nothing else to do, their nurse went against hospital policy and decided to place both babies in the same incubator.

She left the twin girls to sleep and when when she returned she found a sight she could not believe. She called all the nurses and doctors and this is what they saw (refer to the picture above).

As Brielle got closer to her sister, Kyrie put her small little arm around her, as if to hug and support her sister. From that moment on, Brielle's breathing and heart rate stabilized and her health became normal.

NRI facing property encroachment? Steps to get it back

Living overseas with limited ability to supervise their property, Non Resident Indians (NRIs) are often victims of property encroachment in India. "Typically people buy land for investment purposes and may seldom visit the plot of land. Such land becomes an easy target for encroachment because the wrong-doers know that the person is not supervising/ checking on the land and they also know that on encroachment it is difficult for the owner to fight a legal battle in absentia. Similarly, houses of NRIs are soft targets where tenants who have lived long enough may refuse to vacate a rented place. In most situations, the legal way of eviction is cumbersome and time consuming because the tenancy laws in most states are skewed in favor of the tenants," explains P Sunder, Managing Director of yourmaninindia.com, a TTK Services company.

Nidhi Singh, Founder Director of legal consultancy firm nrilegalservices.com agrees, "A possessor enjoys certain judicial protection against third parties even if he is not the owner. This is in order to obviate unlawful acts of violence against the person in possession. However, illegal occupants take advantage of the prevalent laws with respect to possession and many owners face a lot of problem and harassment to get back their properties. The problem is worse in cases of NRIs who are not physically present to look after the properties and forced to depend on locals to look after the properties and litigation if any."

Prevention, then, is obviously better than cure and we have seen in an earlier article the various steps NRIs can take to prevent property encroachment. However, if your property has already been encroached upon, don't lose heart. "There are remedies provided under the law to get back the properties or protect any third party trespassing or interfering in the peaceful possession," Singh points out. But, as Sunder says, "be mentally prepared for a long haul."

Here's what you can do if your property has been encroached upon:

Step 1: Get your documents in order

"Remedies are available under section 5 and 6 of the Specific Relief Act, 1963. A person who is dispossessed from his property can get possession on the basis of title and may recover possession merely by proving previous possession and subsequent wrongful dispossession," says Singh.

In order to be able to prove that, it is important to have your documents in order. "To establish right on the property the owner or a person claiming possession must have documents such as the title deeds, jamabandis, mutation/ intkal, copy of the Will (if any) where the property has been inherited by way of a Will, original purchase agreement/sale deed, electricity bills, water bills and telephone bills etc.," Singh advices. "In addition, keep all payment receipts, cheques, bank drafts (if any) paid to the sellers and annual property tax receipts," advises Bangalore based Advocate Lokesh Anjanappa.

Step 2: Seek legal help

Find yourself a lawyer who can help you to quickly draft suitable notices of eviction and have them sent to the illegal occupants. "Discuss at length with the lawyer every minute detail pertaining to the disputed property and file a civil suit seeking 'restraint order' or 'injunctive relief' (Stay) against any continuing threat. Try and obtain copies of the encroacher's documents on which basis an illegitimate claim has suddenly cropped-up in air," says Anjanappa.

Step 3: File a police complaint

"In addition to the Specific Relief Act, proceedings can also take place under section 145 of the Criminal Procedure Code. In states like Punjab, the Government has taken steps such as setting up of NRI police stations where a person who apprehends trespassing or wrongful dispossession can lodge a written complaint. In fact, a written complaint can be sent to the Superintendent of Police (SP) by way of registered post. Even if the SP fails to respond, a private complaint in the court can be filed through an advocate and the case can then be pursued through a special power of attorney (a relative or a close friend) where it is difficult for the owner to be present in India," says Singh. "You can even file a complaint in any police station if there are any threats of bodily harm from the party," says Sunder.

Step 4: Be open to negotiation

"Knowing that there are people backing you up could make the encroacher change mind. Also, keep the window of negotiation open so that the futility of it can be impressed upon the encroacher. Considering the financial impact on the property, legal fees, professional charges, lengthy trial period, related expenses, etc., the encroacher may think it more wise to invite the litigating party for some favorable out of court negotiations/settlement," Sunder says.

Step 5: Be patient

"Timelines in litigation in India are difficult to speculate. On an average a case takes a minimum of 2-3 years. The cost of litigation varies from case to case. It depends on the city where the case is filed (litigation cost is steep in cities like Delhi, Mumbai, Ahmadabad), the complexity of the case and type of lawyer engaged (for instance a designated Senior counsel who might charge on per hearing basis or lawyer with an experience of 10-15 years)," Singh says. Getting back encroached property is often a long winding legal process. The above steps provide a broad guide on what to do if you are in a similar situation. Grandmaw’s Tried and True Homemaking Tips


I quit my office job to be a stay-at-home-wife when I was in my first trimester of pregnancy. I didn't know the first thing about homemaking, at least not full-time homemaking. Without hesitation, I called my grandmother (aka, Mamaw) and begged for tips on how to make a house a home. She's going to be embarrassed, but I'm going to share her homemaking wisdom with you.

Grandmaw's Tried and True Homemaking Tips that Work:

1. Get up and get dressed.

Don't stay in your pajamas all day and expect to be productive. Not to mention, you never know when someone may call on you. Comb your hair, brush your teeth, and put your shoes on, you have a house to keep, children to feed, and a husband to kiss. She didn't say that last part, but I've seen her kiss my Papaw. They didn't get four kids without kissing, I tell ya'. So get dressed.

2. Treat homemaking as a full-time job.

Homemaking is a full-time job. Treat it like one. The home is your domain to keep and tend. Just as there are things that must get done in the office, there are must-dos at home. Do them every day even if it already looks clean.

3. Be done by 10am.

There are daily chores that you should do every day: make your bed, wipe your bathroom counters, pick-up dirty clothes, do the dishes, sweep the floors, and shine your sink. You will have your own routine. Stick to it and be done by 10 o'clock. People will start calling and there are other things you will need to do. Don't waste all day on these easy tasks.

4. Stick to the work week.

Housekeeping is for Monday through Friday. Saturdays are for family. Sundays are for the Lord. Enjoy the weekend.

5. Children come before housework.

There will be times your husband will leave for work and return to a house that looks the same or worse than when he left it. You can't keep a doll house all the time, and that has to be okay! Tend to the babies first and get a towel from the dryer for your shower. Love your babies and care for them as only you, their mother, can do. It is such a short season.

6. Do what works for you.

Always remember, everyone is different and everyone likes to give their opinions. Just listen, and then, do what works for you. Half the time, the person who gave you the advice won't know, or care, what you ended up doing. Your home is your domain. Don't compare it to others. Make it a place you enjoy!

Homemakers as valuable as earning members

The Allahabad high court has upheld that a married woman as a housewife and mother usually puts in more hours of work for the family than the earning members of the family and their contribution should not be considered any less.

The court upheld that the work of a homemaker must be assigned value in terms of money for working out compensation to the remaining family members who are dependents on services provided by her and her contribution to the family.

Giving this judgment, a division bench of Justice Sunil Ambwani and Justice A N Mithal dismissed a first appeal from order filed by the Reliance General Insurance Company Ltd.

The court upheld the order passed by Motor Accident Claim Tribunal of Maharaj Ganj, which awarded the compensation of Rs 2,68,500 to be paid by the insurance company to the legal representative and dependants of Safia Khatoon, aged about 50 years, who died in a road accident.

The court rejected the plea of the counsel appearing for the Insurance Company, who had said that since the woman had no income it could not be said that any of the claimants were dependent on her income to receive compensation.

The court said "On the present value of money, the notional income of Rs 30,000 per month suggested in Sarala Verma's case at Rs 1,000 per day in the year 2009 for calculating the income of a person whose employment was not proved by any reliable evidence will be equally-applicable to the married women, whose contribution to the family as a home maker has to be given the same value as other earning members".

பாலைவனத்தில் பயணம் செய்து கொண்டிருந்த ஒருவன் கொண்டு வந்திருந்த தண்ணீர் தீர்ந்து விட்டது. அவன் போக வேண்டிய தூரமோ அதிகம். குடிக்கத் தண்ணீர் இல்லாமல் அவன் மயங்கி விழும் நிலைக்கு வந்து விட்டான். இந்தப் பாலைவனத்திலேயே தாகத்தால் உயிரை விட்டு விடுவோமோ என்று நினைத்துக் கொண்டு இருந்த போது தூரத்தில் ஒரு குடிசை போல ஏதோ ஒன்று தெரிந்தது. கால்களை நகர்த்தவே மிகவும் கஷ்டமாக இருந்தாலும் எப்படியோ கஷ்டப்பட்டு அவன் அந்த இடத்திற்கு சென்று விட்டான்.

அங்கே ஆட்கள் யாரும் இல்லை. ஒரு கையால் அடித்து இயக்கும் பம்ப் செட்டும் அருகே ஒரு ஜக்கில் தண்ணீரும் இருந்தன. ஒரு அட்டையில் யாரோ எழுதி வைத்திருந்தார்கள். "ஜக்கில் உள்ள தண்ணீரை அந்தப் பம்ப் செட்டில் ஊற்றி அடித்தால் தண்ணீர் வரும். குடித்து விட்டு மறுபடியும் ஜக்கில் தண்ணீரை நிரப்பி வைத்து விட்டுச் செல்லவும்."

அந்தப் பம்ப் செட்டோ மிகவும் பழையதாக இருந்தது. அந்தத் தண்ணீர் ஊற்றினால் அது இயங்குமா, தண்ணீர் வருமா என்பது அவனுக்கு சந்தேகமாக இருந்தது. அது இயங்கா விட்டால் அந்தத் தண்ணீர் வீணாகி விடும். அதற்குப் பதிலாக அந்தத் தண்ணீரைக் குடித்து விட்டால் தாகமும் தணியும், உயிர் பிழைப்பதற்கு உத்திரவாதமும் உள்ளது.

அந்தப் பயணி யோசித்தான். தண்ணீரைக் குடித்து விடுவதே புத்திசாலித்தனம் என்று அறிவு கூறியது. ஒரு வேளை அதில் எழுதி வைத்திருப்பது போல் அந்தப் பம்ப் இயங்குவதாக இருந்து அது இயங்கத் தேவையான அந்தத் தண்ணீரைக் குடித்து விட்டால் அது மகாபாதகம் என்று இதயம் சொன்னது. இனி தன்னைப் போலத் தாகத்தோடு வருபவர்களுக்கு அது பயன்படாமல் போகத் தானே காரணமாகி விடுவோம் என்று மனசாட்சி எச்சரித்தது. அவன் அதற்கு மேல் யோசிக்கவில்லை. ஆனது ஆகட்டும் என்று அந்தப் பம்பில் அந்தத் தண்ணீரை ஊற்றி விட்டு அதை அடித்து இயக்க ஆரம்பித்தான். தண்ணீர் வர ஆரம்பித்தது. தாகம் தீர, வேண்டிய அளவு தண்ணீர் குடித்து விட்டு அந்த ஜக்கில் நீரை நிரப்பி விட்டுச் செல்கையில் அவன் மனம் நிறைந்திருந்தது.

இந்த நிகழ்ச்சியில் இரண்டு படிப்பினைகள் உள்ளன. ஒன்று நாம் அவசியமான காலத்தில் அனுபவிப்பதை அடுத்தவருக்கும் அதே போல பயன்படும்படி விட்டுப் போக வேண்டும். எந்த நன்மையும் நம்முடன் நின்று விடலாகாது. இந்தக் காலக் கட்டத்தில் பெரும்பாலான மனிதர்களிடம் அந்த நல்லெண்ணம் இருப்பதில்லை. நம் வேலை ஆனால் சரி, அடுத்தவர் எக்கேடு கெட்டால் நமக்கென்ன என்ற அலட்சியம் பலரிடமும் மேலோங்கி உள்ளது. "யான் பெற்ற இன்பம் பெறுக இவ்வையகம்" என்ற மனநிலையில் ஒவ்வொருவரும் இருந்தால் இந்த உலகம் இன்பமயமாகி விடுமல்லவா?
